The Ministry of Digital has published the criteria for selecting an operator for the registry of hosting providers

The Ministry of Digitization has published for public discussion a draft document with criteria for selecting an operator for the registry of hosting providers.

In the explanatory note to this project, it is stated that in accordance with the law “On Communications”, Roskomnadzor may involve the operator of such a register – an organization registered on the territory of the Russian Federation – in the formation and maintenance of the register of hosting providers.

The draft resolution of the Ministry of Digital Affairs establishes the following criteria for such an organization:

  • the availability of the technical possibility to receive notifications from hosting providers about the start of activities to provide computing power for placing information in an information system that is permanently connected to the Internet, which are sent using a personal account on the official website of Roskomnadzor;

  • availability of technical and organizational capabilities for maintaining the registry of hosting providers in an automated mode, including the possibility of interaction with hosting providers;

  • conducting independent monitoring of the public communication network and the “Internet” network to identify information security vulnerabilities of the Russian information and telecommunications infrastructure.

From December 1, 2023, Roskomnadzor will be responsible for maintaining the register of hosting providers. The agency must formulate rules for maintaining the register, requirements for providers to be included in the register, and also monitor providers’ compliance with these requirements. According to the law, hosting providers must also use the national system of domain names, as well as provide access to the FSB and RKN for conducting investigative activities. Hosting will be able to provide its services only to persons who have passed the authentication procedure in accordance with the procedure established by the government.

To be included in the register, providers will have to send a message to the RKN, which will be considered within ten working days. In addition, providers must notify RKN about the start of activity no later than ten working days before its start through a personal account on the regulator’s website, one of the acts states. Providers already in operation must report this by December 15, 2023 at the latest.

From February 1, 2024, the activities of hosting providers that are not included in the register of hosting providers will not be allowed. Hosting providers who have not entered the register will not be able to carry out their activities, says Nikita Tsaplin, the founder and general director of the RUVDS hosting provider. “That is, if earlier hosting could generally even ignore requirements from state structures and they could not do anything to it, now such hosting can be excluded from the register and prohibited from working in this way,” he explained.

The representative of the RKN informed the mass media that the organization – the operator of the registry may be tasked with creating a system, including and removing hosting providers from the registry, and making changes to registry entries. “The decision to include or exclude providers is made by the head of the RKN or his deputy,” the department clarified.

Profile experts explained that the operator of the registry of hosting providers, most likely, can become the State Radio Frequency Center (a subordinate RKN of the State Radio Frequency Center). They also named Rostelecom’s “Internet Technical Center” (TCI) and the National Coordination Center for Computer Incidents (NCCCD) of the FSB as examples of a possible registry operator.
