Journalists from Bloomberg reported that Apple is considering releasing a software patch for the Apple Watch. The company believes that thanks to this, it will be possible to bypass the ban on the sale of a smart watch in the United States. For now, Apple is waiting for the decision of the appeals court and is working out possible scenarios.

Apple announced this week that it is discontinuing sales of the Apple Watch Series 9 and Ultra 2 in the US. From December 21, 2023, it will not be possible to buy the watch in an online store, and from December 24 – in a retail store. We had to take such a step because of a lost patent case. Medical company Masimo believes that Apple infringed a number of patents while developing a sensor to measure blood oxygen levels.

The company disagrees with the commission’s decision, so Apple plans to file an appeal on December 26, 2023. Instead, the corporation’s lawyers are studying possible ways around the ban. Bloomberg journalists said that Apple is working on an option to make changes to the firmware of the smart watch. Masimo’s representatives demand a redesign of the hardware, but Apple is confident that it is enough to make corrections only to the algorithm to satisfy the court’s requirements.

Another option to bypass the ban can be a license agreement with Masimo. Experts believe that Apple will not take such a step and will try to avoid making agreements and payments. The company has not announced a plan of action yet and is waiting for the court’s decision. All comments will be made by Apple representatives after December 25, 2023.
